Terms of Service

These Terms of Service ("Terms") govern your use of Aether Protocols software, documentation, and related services ("Services") provided by Nexus Concordat ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part, you may not use our Services.

1. License Grant

Subject to these Terms and the Aether Protocols License, we grant you a limited, non-exclusive, non-transferable license to use the Services as follows:

• Personal Use: Free. You may use, modify, and run the software for personal projects.
• Research Use: Free. Academic and research applications are permitted with attribution.
• Commercial Use: Requires a separate commercial license agreement. Contact us before deploying in any revenue-generating application.

2. Patent Notice

Aether Protocols is covered by U.S. Patent Application No. 63/939,190 (filed December 12, 2025). All uses of the architecture must include appropriate patent pending notices as specified in the License.

3. Experimental Software

We make no warranties regarding:

• Fitness for any particular purpose
• Reliability or availability
• Security or data integrity
• Compatibility with your systems

4. Prohibited Uses

You may not use our Services to:

• Cause unlawful physical harm to any person
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Redistribute the software without proper attribution
• Remove or alter patent pending notices
• Sublicense or transfer your license without written permission

5. Attribution Requirements

All uses require visible attribution to Nexus Concordat including:

• Documentation and README files
• About screens or credits sections
• Technical documentation
• Any public-facing materials describing the technology

6. Account Registration

To access certain features (such as the GitLab repository), you must register an account. You agree to:

• Provide accurate registration information
• Maintain the security of your credentials
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized access

7. Data Collection

We collect minimal data necessary to provide our Services:

• Account registration information
• Usage analytics (anonymized)
• Support communications

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXUS CONCORDAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Nexus Concordat from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted to this page with an updated effective date. Continued use after changes constitutes acceptance.

11. Termination

We may terminate or suspend your access immediately, without prior notice, for any breach of these Terms. Upon termination:

• Your license rights cease immediately
• You must destroy all copies of the software
• Sections regarding liability, indemnification, and intellectual property survive termination

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the State of [Your State], and you consent to personal jurisdiction there.
